Do I need a lawyer to get a divorce?

The strictly technical answer to this question is "no." There is nothing in the California Family Code that requires you to use an attorney to file for dissolution of marriage. However, it is HIGHLY recommended that you either use an attorney or at minimum consult an attorney to prepare you for what is coming. In very simple situations an attorney will not be necessary, however, for the vast majority of divorces - it is not a simple matter. Usually there is a large amount of real or personal property that is to be divided, or child custody and support matters that need to be resolved. It is often useful to have someone representing your interest that is not as emotionally tied to the situation that can calmly and rationally explain your options and aggressively protect your rights during the dispute.
