Can I file for divorce if my spouse lives in another state or county?

Yes. If you have lived in California for at least six months and in your county for three, you can file for divorce in your county. However, you must serve your out-of-state spouse with the petition in order for it to be effective, and if there is a minor child involved a California court may not have jurisdiction to enter any orders regarding the child if they live in a different state or county.
