What do I do if my spouse threatens me or the children?

If you or the children have been threatened by your spouse, you can obtain a protective order. This is done by filing an “ex parte” order and appearing before the court in as little time as 24 hours. You will have to explain to the court that without the order you or your children will suffer irreparable harm or you want to maintain the status quo. These orders are often granted based on your declaration. Because this is an emergency, the court will schedule a second, or follow-up, hearing so that your spouse will be able to respond.
